Update: Judgment on the application for an injunction – Westmount against MTQ
In the matter involving the City of Westmount against the Ministère des Transports, de la Mobilité durable et de l’Électrification des transports du Québec (“MTQ”) and KPH-Turcot, a judgment was rendered on May 17, 2018 by the Honorable Justice Élise Poisson, of the Superior Court of Québec. This judgment can be viewed here.
We will study the judgment in more detail and consult with our lawyers to consider all our options.
One thing is certain, the City will continue to work to ensure that its citizens have the quality of life to which they are entitled once the work on Route 136 is completed. Notwithstanding the interlocutory judgment rendered, the noise level, as it is projected by the MTQ once Route 136 will be completed, will constitute a major source of contamination which will impact the health of our citizens living near the highway. We believe that the MTQ should act now in a context which sees residents being victimized by a modification to the design of Route 136. We firmly believe that the Quebec Government should proactively deal with the noise issue immediately, during the construction of the new highway, and not when it is completed.
While we did not receive the judgment we hoped for at this preliminary stage of the file, legal procedures are ongoing and we still hope to win our case at trial. Given the foregoing, we will not comment further at this time.
